Beijing& stated opposition to Japan’s claim is based on its belief that Japan and the United States illegally signed the 1951 San Francisco Treaty without the presence of China (one of World War II’s victorious countries).
According to the Chinese, the islands should have been returned to China after World War II, under the provisions of the 1943 Cairo Declaration, the 1945 Potsdam Proclamation and Article 2 of the San Francisco Treaty.
Japan claims that the islands have always been treated as part of Okinawa and were not transferred under the Treaty of Shimonoseki.

 The Territorial Dispute Over Dokdo
Although the 1952 San Francisco Peace Treaty between Japan and the former allied powers settled sovereignty over the islands of Ullungdo, Kommundo, and Chejudo (all to Korea), the ownership of Dokdo was not settled in the treaty.
In fact, the Rhee government never bothered to produce a scholarly, well-documented study of the Korean historical record on Dokdo that could offer the American drafters of the peace treaty an alternative to the Japanese Foreign Ministry´s monograph, "Minor Islands in the Sea of Japan".
Even after the peace treaty was signed and talks on the normalization of relations between the ROK and Japan were underway, the Korean demand for recognition of their country´s sovereignty over Dokdo continued.

Japan maintains that it settled the issue of postwar indemnity under the San Francisco peace treaty it signed with the United States and other Allied powers in 1952, as well as under subsequent war reparation agreements it concluded with various countries.
On this, the South Korean experts argue that South Korean individuals still have the right to claim postwar redress from Japan because the issue of the wartime sex slaves has not been adequately discussed.
Japanese and South Korean historians presented differing views on key historical events involving the two countries in a report released Friday as part of a bilateral project aimed at promoting mutual understanding and bridging gaps in history perceptions.

After signing the Japanese Peace Treaty in San Francisco on the 8th, the ``Big Three'' Foreign Ministers had gone to Washington D.C. to engage in fresh talks expected to lead to a comparable settlement with Western Germany later in 1951.
The talks were also expected to touch upon pressing international problems including Korea, China, Kashmir, the Anglo-Persian Oil dispute, the Anglo-Egyptian Treaty, East-West trade, and admitting Greece and Turkey into the Atlantic Pact.
U.S. Secretary of State Dean Acheson hoped that the talks would clear the way for signing a provisional peace settlement with Western Germany first, and then to conclude a security agreement for that nation to make its contribution to Western defence.

Treaty of Peace between Japan and the Republic of China: “As a sign of magnanimity and good will towards the Japanese people, the Republic of China voluntarily waives the benefit of the services to be made available by Japan pursuant to Article 14 (a) 1 of the San Francisco Treaty.''
No one really believes that Japan as a nation believed that her past actions during WWII were good and not in need of apology, but the issue is really about if the action of the goverment AND ordinary citizens are actually manifestations of remorse.
Though there are historical revisionists (like Ishihara, text-book revisionists, etc.) who are becoming influential in the political scene in Japan, I believe that after the WWII most of Japanese people deeply regretted the result of the cruel war and the disaster.
