Secretary of Defense Donald Rumsfeld said that the suspects could not count on being released, even if the commission ruled that they were innocent of their charges.
And these memos reported that they were told that all the evidence that might prove the suspect's innocence could be classified as national security secrets, so the suspects would not receive access to it.

One of the tribunal's assertions is that Kurnaz was traveling to Pakistan with Selcuk Bilgin, who Kurnaz said was a friend from his gym and who the military said is suspected of being "the Elalananutus suicide bomber."
The three officers on the panel, whose identities are kept secret, said in papers filed in federal court that they reached their conclusion based largely on classified evidence that was too sensitive to release to the public.
The R-19 memo, she wrote, "fails to provide significant details to support its conclusory allegations, does not reveal the sources for its information and is contradicted by other evidence in the record." Green reviewed all the classified and unclassified evidence in the case.

Lawyers familiar with the case shrugged off the possibility that the government would be wary of a public outcry that could result if authorities brought Moussaoui before a military tribunal.

Moussaoui, a French citizen of Moroccan descent, is the only person charged with crime for the terrorist assaults that led to 3,016 deaths at the World Trade Center and the Pentagon, and in rural Pennsylvania.
Brinkema had decided that, because federal prosecutors would not produce three Al Qaeda captives they are holding as witnesses at Moussaoui's trial, all evidence seeking to show he helped plan or carry out the Sept. 11 attacks would be excluded from the case.
US Attorney Paul J. McNulty, who leads the prosecution team, said last week that "the interests of justice require that the government have the opportunity to provide the full scope of the conspiracy alleged."

 PM - Hicks to be tried by military tribunal
The military commission does have the power to hand down death penalties and the reports from the United States in recent weeks have been that they are currently planning construction of an execution chamber in Guantanamo Bay.
I would have thought out of 660 people there, it's very unlikely that a person from Adelaide, who had recently arrived in Afghanistan, would hardly be a high level al-Qaeda operative.
The Federal Attorney-General, Daryl Williams, confirmed today that the US government has decided to establish military commissions to try Mr Hicks and other suspected terrorists, but says no charges have yet been laid against the Adelaide man.

The order states that those tried cannot seek remedies in a U.S. court, foreign court, or international court.
Non-citizens who are former or current members of al-Qaida and non-citizens who have "engaged in, aided or abetted, or conspired to commit" acts of international terrorism against the "United States, its citizens, national security, foreign policy, or economy." In addition, non-citizens who knowingly harbor terrorists may be subject to the military tribunals.
Convictions and sentencing will take place if there's a two-thirds vote "of the members of the commission present at the time of the vote," as long as a majority of the members are present.

Former world number one Marcelo Rios has been cleared by a Chilean military tribunal over allegations that he attacked police officers outside a Santiago bar in September.
Rios was alleged to have attacked officers when they arrested him outside the bar after waiters refused to serve him following several hours of drinking.
It was passed on to the military tribunal because the police come under the defense ministry control.
